I’m 5’6 and waist 34 would have have to get an XXL?

I would say yes. XL is 32-33. They say go up a size if you want a loose fit. I'm a 32 with a little bit of a beer gut and I got the XXL. They were a little big but I kept them as I wanted to wear them right away. So I would say get the XXL as they are tapered so they're tighter towards the bottom.

Do these have a back pocket?

No back pocket!!.. But you will still love the fit..
