Yes there is some stretch in the crotch area, but then there is some stretch in the material overall. The crotch area has been made slightly looser to ensure the contents comfortable. Be aware however, that there is no gap to enable urination. The crotch area has be pulled aside which may be difficult for some men.

Would xl be right for 38 waist

If this the usual size for 38 waist yes, I bought M for a 32 waist, the size I normally buy and they are fine
